Interested in helping make Morgan County a cleaner community?

The Morgan County Code of Ordinances has regulations to help keep our county free of trash and debris. The following information may be of interest to you.

Section 34-102 – Deposit of Garbage, Trash, Brush and Weeds Prohibited

It shall be unlawful for any person to sweep, throw or deposit any garbage, trash, brush, stagnant water, dead animals, discarded items or other debris into, upon or along a drain, gutter, street, sidewalk, vacant lot or upon any public or private premises within the county.

Section 34-103 – Littering of Streets, Roads, and Sidewalks Prohibited

It shall be unlawful for any person to place, store, dump, park or broadcast any junk, metal, brickbats, stones, plaster, lumber, trash, garbage, litter, paper or similar rubbish and junk upon any public street, road, or sidewalk in the county.

Section 34-105 – Transport of Refuse

  1. It shall be unlawful for any person to transport any garbage, trash, refuse, or other cargo upon the public thoroughfares in the county if the same is of a character or substance which is likely to be deposited from the motor vehicle onto the public rights-of-way unless the same is secured by containers, tarpaulin, or other device in such fashion as to effectively prevent such deposit on the public rights-of-way.

  2. The duties and responsibilities herein imposed shall be applicable alike to the owner of the motor vehicle and the operator thereof.

Section 12-101 – Solid Waste, Litter and Junk

3 - Transporting Litter and Waste:

  1. It shall be unlawful to drive or operate a vehicle in the county hauling wet or moist litter or waste which leaks, flows freely or spills from such vehicle.

  2. Any litter or waste hauled on a moving vehicle in the County shall be covered or secured in such a manner that the litter or waste will not blow or escape from said vehicle while moving or parked on public streets or roadways in Morgan County.

  3. It shall be unlawful for any vehicle to transport litter or waste on any public streets, or roadways, in Morgan County without suitable coverings or other restraint devices securely fastening such litter or waste to the vehicle so as to prevent any materials from being deposited on the roads or adjoining areas of the county. However, this section shall not prohibit the necessary spreading of any substance in public road maintenance or unreasonably interfere with bona fide agricultural operations.

  4. The duties and responsibilities herein imposed shall be applicable alike to the owner of the motor vehicle and operator thereof.

4 - Regulation of Box Dumpster Sites and Compactor Sites:

  1. All box dumpster site or compactor sites shall be maintained in as sanitary a manner as is reasonably possible consistent with its use for garbage and litter disposal.

  2. Persons using box dumpster or compactor sites shall deposit all authorized garbage and refuse in the container or receptacle.

  3. Only household garbage may be deposited in the container or receptacle.

  4. No person shall deposit any burning or smoldering material in any such container or receptacle.

  5. No person shall set fire to the contents of any such container or receptacle.

  6. No dead animals shall be deposited in any such container or receptacle.

  7. No person shall deposit large non-compactable articles in such containers or receptacles such as appliances, bed springs, mattresses, tires, air conditioning units, construction material, tree limbs, lawn trimmings, furniture, or similar items.

  8. No person shall deposit any flammable or explosive materials in any such containers or receptacles.

  9. No person shall place or scatter litter or waste in or around such containers or receptacles.

  10. All other refuse or trash must be taken to Morgan County Landfill.

  11. No one shall deposit any hazardous materials in or around such containers or sites.

  12. Only residents of Morgan County are permitted to make use of dumpsters or dump or place garbage or debris of any kind within Morgan County.

  13. No person shall enter into said receptacle or container, place any part of his or her person within such receptacle or container or use any tool to remove or attempt to remove any object or item from any such receptacle within Morgan County.
